Website scope; separate service agreements

The site provides general information about TAG and lets visitors request information, run the limited Public Signal Scan, complete an assessment, subscribe to updates, or request a strategy session. Consulting, development, managed services, licensing, implementation, support, pricing, service levels, confidentiality, data processing, and deliverables require a separate written agreement. If that agreement conflicts with these Terms, the signed agreement controls for the purchased services.

Acceptable use

You may use the site only for lawful purposes and in accordance with these Terms. You may not:

• Interfere with, overload, disrupt, or bypass the site, its rate limits, access controls, or security measures.
• Probe, scan, or test systems without written authorization; introduce malicious code; or use the site to attack another person or system.
• Use automated means to scrape or extract content in a way that creates unreasonable load or violates applicable law, except ordinary search-engine indexing that follows our robots instructions.
• Misrepresent your identity or authority, submit information you are not entitled to provide, or use the Public Signal Scan against a domain you are not authorized to assess where authorization is legally required.
• Copy, modify, resell, reverse engineer, or create derivative works from the site except as applicable law expressly permits.

Intellectual property

The site, its design, software, text, graphics, trademarks, and other TAG materials are owned by TAG or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, TAG grants you a limited, revocable, non-exclusive, non-transferable license to access and use the site for your own internal business evaluation.

You retain ownership of information you submit. You represent that you have the right to provide it and grant TAG permission to host, process, reproduce, and use it as reasonably necessary to operate the requested workflow, respond to you, secure the site, and comply with law. This permission does not give TAG ownership of your submission.

Assessment, scan, and site information

Public Signal Scan findings are based on publicly observable technical signals and may be incomplete, outdated, or affected by third-party configuration. Assessment outputs, modeled opportunities, examples, case-study structures, and other site content are informational only. They are not a guarantee of revenue, savings, performance, accuracy, availability, or business outcome and are not legal, tax, accounting, investment, employment, or cybersecurity advice.

You are responsible for evaluating information before relying on it and for obtaining appropriate professional advice. A booking request is not confirmed until the booking provider returns confirmation.

Third-party services and links

The site may depend on or link to services operated by others. TAG does not control their content, availability, security, or privacy practices and is not responsible for them. Your use of a third-party service may be governed by that provider's terms and privacy notice.

Disclaimer of warranties

To the fullest extent permitted by law, the site is provided "as is" and "as available." TAG disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, TAG and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from or related to the site.

To the fullest extent permitted by law, the aggregate liability of TAG and those parties for claims arising from or related solely to use of this public website will not exceed one hundred U.S. dollars (US $100). This limitation does not exclude liability that applicable law does not permit us to exclude or limit. A separate signed service agreement may establish different remedies and limits for paid services.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold TAG and its owners, officers, employees, contractors, and affiliates harmless from third-party claims, damages, and reasonable costs arising from your unlawful misuse of the site, your violation of these Terms, or information you submit without the necessary rights or authority.

Suspension and termination

We may suspend or terminate access to the site when we reasonably believe use violates these Terms, threatens people or systems, creates legal exposure, or could harm TAG or others. Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability limits, and governing law, will survive.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to any law that requires otherwise, claims concerning these Terms or the public website must be brought in a court of competent jurisdiction in Texas.

Changes to these terms

We may update these Terms by posting a revised version and effective date. Changes apply prospectively when posted. Your continued use of the site after an update means you accept the revised Terms.

General

If a provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement concerning use of the public website, except for any separate signed agreement that applies to TAG services.
